Welcome to Skooqs, an online learning community enabling kids to develop their creative and entrepreneurial skills. The Skooqs website and service including (without limitation) www.skooqs.com (the “Site”) and other all websites, mobile applications and other interactive properties through which the service is delivered (collectively, the “Services”) are owned, operated and distributed by The Creative Kids Zone Initiative., (referred to in this Privacy Policy as “Skooqs” or “we” and through similar words such as “us,” “our,” etc.). By accessing any part of the Services, you are agreeing to the terms and conditions described below (this “Privacy Policy”) and the terms and conditions of our terms of service (the “Terms of Service”). If you do not agree to any of these terms, you should not use the Services. This Privacy Policy applies to all users, including both users who are simply viewing content available via the Services and users who have registered as members of Skooqs.

We may, at our sole discretion, modify this Privacy Policy at any time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make material changes in the way we collect or use information, we will notify you by posting an announcement on the Services or sending you an email. By accessing the Services at any time after such modifications, you are agreeing to be bound by the updated policy. This Privacy Policy was last modified as of September 12, 2021.

Your privacy is very important to us. Accordingly, we have developed this Privacy Policy in order for you to understand how we collect, use, communicate and disclose and make use of Personal Data (as defined below). The following outlines our privacy policy.

Consent

By accessing or using Our services or Products, you agree to the collection and use of information in accordance with this Notice. Once you provide consent, you may change your mind and withdraw the consent at any time by contacting us at [email protected], but please note that consent withdrawal will not affect the lawfulness of any processing carried out before you withdraw your consent.

What Does This Privacy Policy Cover?

This Privacy Policy covers Skooqs’s treatment of personally identifiable information (“Personal Information”) that Skooqs gathers when you access Skooqs and when you use Skooqs’ services. This policy does not apply to the practices of companies that Skooqs does not own or control (including any third-party products or services used for logging into Skooqs or that are integrated with the Skooqs), or to individuals that Skooqs does not employ or manage. Skooqs may contain links to other sites. Skooqs is not responsible for the privacy policies and/or practices on other sites. When linking to another site a user should read the privacy policy stated on that site

What Personal Information does Skooqs Collect?

The information we gather from users enables us to provide, personalize and improve our services, and allows our users to set up a user account and profile that can be used to personalize their experience on Skooqs and interact with other users through the site. In connection with Skooqs, we request and display some Personal Information to other users and visitors of Skooqs, which allows users to identify one another. We collect the following types of information from our users:

Personal Information you Provide to us

When your register with us and become a Skooqs Member, when you choose to teach or attend a class, we will ask you for Personal Data. “Personal Data” refers to information about you that can be used to contact or individually identify you. This includes, but is not limited to, your name, email address, but does not include your credit card number or billing information. Transactions on Skooqs involving your billing and payment information are processed by Paystack and are subject to their privacy policies. We do not store any of the credit card or banking information that you provide to these payment processors.

In order to send you email from Skooqs, we need your email address. To provide you with additional services, we may also request your name, general location, and telephone number. We may give some or all of this information to the teachers for classes that you sign up for so that they can coordinate their classes. We will not give your name, email, or other Personal Data to unaffiliated third parties except with your consent or as otherwise set forth in this privacy policy. Though we employ industry standard measures to preserve user privacy, we may need to disclose Personal Data when required by law or when we have a good faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process that we receive or to protect our interests or the safety of others. In addition, we may provide Personal Data to employees, consultants or other business or persons for the purpose of processing such information on our behalf. In such circumstances, we require that these parties agree to protect the confidentiality of such information and to comply with the terms of this Privacy Policy. We may use your Personal Data to operate, improve, understand and personalize our Services. 

Voluntary Disclosure

Any Personal Data or content that you voluntarily disclose in public areas becomes publicly available and can be collected and used by other users for any reason. Your profile pages (“Profile”) and any online classrooms you participate in are typically publicly available. You have the ability to change your account settings to limit access to your profile, and may delete content you post to public classrooms. If you need assistance with controlling your account privacy settings or with deleting content, please contact us at [email protected]. Removal of posted content does not ensure complete or comprehensive removal of the content or information (e.g., some content may be “invisible” to other users but remain on our servers in some form). You should exercise caution before disclosing your Personal Data via these or any other public venues.

For example, if you choose to sign up for a Skooqs account, you may have a Profile on the site, containing your full name and some basic information including your location and bio. You may also add additional optional information to your Profile. You may control what type of Profile information is shown to others through your Account Settings. Any information you choose to provide as part of your Profile should reflect how much you want other Skooqs users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage members to think carefully about what information about themselves they disclose in their profile pages. You can review and revise your profile information at any time.

Personal Information Collected Automatically:

We receive and store certain types of information whenever you interact with Skooqs or use our services. Skooqs automatically receives and records information on our server logs from your browser including your IP address, cookie information, browser information, operating system, timezone, device ID, the pages you request, and the actions and path you take on Skooqs.

Generally, our service automatically collects usage information, such as the numbers and frequency of visitors to Skooqs and how they use its various components. Skooqs only uses this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify you personally. This type of aggregate data enables us to figure out how users use parts of Skooqs or services so that we can make Skooqs appealing to as many users as possible, and improve those services. As part of this use of information, we may provide aggregate information to our partners about how our users, collectively, use Skooqs or services. We share this type of statistical data so that our partners also understand how people use Skooqs or services, so that they, too, may provide you with an optimal online experience. Again, Skooqs never discloses aggregate information to a partner in a manner that would identify you personally.

We may receive a confirmation when you open an email from Skooqs if your computer or device supports this type of functionality. Skooqs uses this confirmation to help us make emails more interesting and helpful and to improve Skooqs and our services. You can opt out of these communications by sending us an email at skooqs.tckzone.com.

Information About Cookies

We use your IP address to help diagnose problems with our server, to administer our Services, and to analyze traffic patterns on the Services. The Services also use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser and tell us how and when you visit and use our Site and Services, to analyze trends, learn about our user base and operate and improve our Services. For example, we use Cookies to deliver content specific to your interests, to save your password so you don’t have to re-enter it each time you visit, and to track whether emails we send you have been viewed. Cookies are small files – usually consisting of letters and numbers – placed on your computer, tablet, phone, or similar device when you use that device to visit our Site. We sometimes combine information collected through Cookies that is not Personal Data with Personal Data that we have about you, for example, to tell us who you are or whether you have an account with us. Cookies can either be “session Cookies” or “persistent Cookies”. Session Cookies are temporary Cookies that are stored on your device while you are visiting our Site or using our Services, whereas “persistent Cookies” are stored on your device for a period of time after you leave our Site or Services. The length of time a persistent Cookie stays on your device varies from Cookie to Cookie. We use persistent Cookies to store your preferences so that they are available for the next visit, and to keep a more accurate account of how often you visit our Services, how often you return, how your use of the Services may vary over time. We also use persistent Cookies to measure the effectiveness of advertising efforts. Through these Cookies, we may collect information about your online activity after you leave our Services. Some Cookies are placed by a third party on your device and may provide information to us and third parties about your browsing habits (such as your visits to our Site or Services, the pages you have visited and the links and advertisements you have clicked). These Cookies can be used to determine whether certain third party services are being used, to identify your interests, to retarget advertisements to you and to serve advertisements to you that we or others believe are relevant to you. We do not control third party Cookies.

We use the following types of Cookies:

  • Essential Cookies: Essential Cookies are required for providing you with features or services that you have requested. For example, certain Cookies enable you to log into secure areas of our Site or Services. Disabling these Cookies may make certain features and services unavailable.
  • Functionality Cookies: Functional Cookies are used to record your choices and settings regarding our Services, maintain your preferences over time and recognize you when you return to our Services.   • Retargeting/Advertising Cookies: Retargeting/Advertising Cookies collect data about your online activity and identify your interests so that we can provide advertising that we believe is relevant to you. 

You can decide whether or not to accept Cookies. One way you can do this is through your internet browser’s settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some Services and functionalities may not work.

Will Skooqs Share any of the Personal Information it Receives?

Personal Information about our users is an integral part of our business. We neither rent nor sell your Personal Information to anyone. To be absolutely clear, we do not and will not sell your, or your child’s data.

Children’s Personal Information

Skooqs will not send Personal Information about a child to other companies or people, except when: we have a parent’s consent to share the information or we are required to do so to comply with the law, including for example, to comply with a court order or subpoena; to enforce our Terms of Service, or site rules; or to protect the safety and security of our users and site.

If Skooqs, or substantially all of its assets were acquired, or in the unlikely event that Skooqs goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. As set forth below, you acknowledge that such transfers may occur, and that any acquirer of Skooqs may continue to use your Personal Information as set forth in this policy.

User profile information including users’ nickname and avatar, email address, and other information you enter (“User Submissions”), may be displayed to other users to facilitate user interaction within Skooqs.

Personal Information other than Child’s Personal Information:

Advertisers: We may allow advertisers to choose the demographic information of users who will see their advertisements and you agree that we may use any of the information we have collected from you (including, without limitation, information you may have decided not to show to other users) to select or allow the advertiser to select the appropriate audience for those advertisements. For example, we may allow an advertiser to target an ad to you based on your query history.

Affiliated Businesses We Do Not Control: We anticipate that we may become affiliated with a variety of businesses and work closely with them. In certain situations, these businesses may sell items to you through Skooqs. In other situations, Skooqs may provide services, or sell products jointly with affiliated businesses. You can easily recognize when an affiliated business is associated with your transaction, and we will share your Personal Information that is related to such transactions with that affiliated business.

Service Providers: We engage third-party companies and individuals to perform services on our behalf (e.g., software maintenance services, advertising serving technologies, e-mail service providers, delivery services, database management, web analytics, payment processing, and other services). These third parties have access to your information so that they may perform these tasks on our behalf and they are prohibited by us from using or disclosing your information for any purpose other than to provide this assistance, except to the extent required by law. We may permit our service providers to use aggregate information which does not identify you or de-identified data for other purposes.

Business Transfers: In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that are transferred. Moreover, if Skooqs or substantially all of its assets were acquired, or in the unlikely event that Skooqs goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur and that any acquirer of Skooqs or its assets may continue to use your Personal Information as set forth in this policy.

Protection of Skooqs and Others: We may release Personal Information when we believe in good faith that release is necessary to comply with any applicable law, regulation, or other legal requirements; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Skooqs, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Except as set forth above, you will be notified when your Personal Information may be shared with third parties and will be able to prevent the sharing of this information.

Data Security

We store and process your personal information on our computers in Nigeria. Where We need to transfer your data to another country, such country must have an adequate data protection law. Please be assured that we have put in place appropriate security measures including but not limited to access controls, firewalls, data encryption, and physical security to prevent your personal data from being lost, altered, disclosed, or otherwise used in an unauthorized way. In addition, we limit access to your personal data to those employees, agents and contractors who have a business need to know. These employees, agents, and contractors have a duty to maintain confidentiality at all times and will only process your personal data according to our instructions.

Also note that We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where We are legally required to do so.

Your child’s Skooqs account is protected by a password for your privacy and security. You need to ensure that there is no unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer (or other device) and browser by signing off after you have finished accessing your account. Skooqs endeavors to protect user information to ensure that user account information is kept private, however, Skooqs cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Skooqs contains links to other sites. Skooqs is not responsible for the privacy policies and/or practices on other sites. When linking to another site you should read the privacy policy stated on that site. This Privacy Policy only governs information collected on Skooqs.

Please be aware that whenever you voluntarily post information to public areas on Skooqs or any other public forums, such information can be accessed by the public.

What Personal Information can I Access?

Skooqs allows you to access the following information about you for the purpose of viewing, and in certain situations, updating or deleting that information. This list will change as Skooqs changes.

  • Real (full) name of child
  • Account and user profile information
  • User e-mail address
  • Username and password
  • User preferences
  • Billing preferences

Parents may review information relating to their child’s account at any time by logging on to the account.

A parent can also contact our customer service department to access, change, or delete Personal Information by sending an e-mail to [email protected].

Please note that Personal Information about a child may remain in backup storage for up to two weeks after a request for deletion of that child’s data. This may be the case even though no information about that account remains in our active user databases.

When Does Skooqs Obtain Parental Consent?

Consent by purchase

In order to participate in Skooqs, a parent or guardian must purchase access by providing their credit card information (note: “Free Trials” are considered “purchases” for the purpose of consent). In so doing, the parent or guardian grants us permission to collect necessary Personal Information from their child. This kind of credit card verification is in compliance with COPPA and ensures an adult is the one signing a child up for Skooqs.

Content generated by a child

Certain activities on our sites and applications allow children to create or manipulate content (like photos, videos and comments) and save it within Skooqs. By registering and creating an account for your child on Skooqs, you grant us permission to share your child’s content within Skooqs, and to share your child’s content publicly on our social media channels as long as it does not contain Personal Information.

Teacher consent in lieu of a parent

With regard to school-based activities, COPPA allows teachers and school administrators to act in the stead of parents to provide consent for the collection of Personal Information from children. Schools should always notify parents about these activities. For more information on parental rights with respect to a child’s educational record under the Family Educational Rights and Privacy Act (FERPA), please visit the FERPA site.

Comment System

Certain activities allow users to communicate directly with other users by means of a comment system. In most cases, these chat systems employ filters that are intended to prevent the communication of both Personal Information and age-inappropriate words and phrases. In addition to filters, we may employ live moderation and/or encourage other users to flag inappropriate communications. We strongly encourage children who use these interactive features on our sites and applications never to provide Personal Information about themselves or any third party, and certainly never to attempt to circumvent our filters or moderation. We also recommend that parents carefully supervise their children when the children participate in online activities.

Where Skooqs employs a comment system that does not filter out Personal Information, we will first seek high-level consent from the parent.

When will Skooqs email me or my child?

We may use your contact information to send emails to you about Skooqs and other related topics that may be of interest to users of Skooqs. You can opt out of these communications by sending us an email at [email protected].

As part of Skooqs’s services, you will receive email and other communication relating to your child’s User Submissions. You acknowledge and agree that by posting such User Submissions, Skooqs may send you email and other communication that it determines in its sole discretion to be related to your User Submissions.

Please note that if you do not want to receive legal notices from us, such as this Privacy Policy, those legal notices will still govern your use of Skooqs, and you are responsible for reviewing such legal notices for changes.

On occasion, in order to respond to a question or request from a child, Skooqs may need to ask for the child’s online contact information, such as an email address. Skooqs will delete this information immediately after responding to the question or request.

In connection with certain activities or services, we may collect a child’s online contact information, such as an email address, in order to communicate with the child more than once. In such instances we will retain the child’s online contact information to honor the request and for no other purpose such as marketing. One example would be a newsletter that provides occasional updates about an activity. Whenever we collect a child’s online contact information for ongoing communications, we will simultaneously require a parent email address in order to notify the parent about the collection and use of the child’s information, as well as to provide the parent an opportunity to prevent further contact with the child. On some occasions a child may be engaged in more than one ongoing communication, and a parent may be required to “opt-out” of each communication individually.

Third-Party Links

Occasionally, We may include or offer third-party products or services on Our Platform as a result, the platform may contain links to other websites or services. We are not responsible for the privacy practices or the content of such websites or services, and you should review the privacy policy of each such website or service to make sure that you are comfortable with it before providing any Personal Data. For example, all teacher payments for classes are processed through third-party payment processors. As discussed above, we do not receive any of the credit card information you provide to our third-party payment processors, and all such information is subject to their privacy policies.

Teachers

As discussed above, we may give your Personal Data to the teachers for classes (“Teachers”) that you sign up for so that they can coordinate their classes. As part of our Terms of Use, Skooqs Teachers agree not to abuse other users’ Personal Data. Abuse is defined as using Personal Data for any purpose other than those explicitly specified in the Teachers’ Class. However, please understand that Skooqs Teachers are not our employees or consultants and that we are not party to any transaction between you and the Teacher. As a result, we cannot control their actions and cannot be held liable for any actions that they may take.

Business Transfers

In the event that we are acquired by or merged with a third-party entity, we reserve the right to transfer or assign the information we have collected from users, including without limitation Personal Data, as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your Personal Data is treated, transferred, or used.

Retention of Personal Information

We will keep your personal information for as long as it is required and in accordance with the purpose, it is being processed for, or for tax, accounting, regulatory, or legal purposes. We will keep the personal data for a period that enables us to handle or respond to any complaints, queries, or concerns relating to Our relationship with you. Related to this, We may retain your personal data for a longer period in the event of a complaint or if We reasonably believe there is a prospect of litigation with respect to Our relationship with you.

You may notify us whenever you no longer wish to hear from us and We will keep minimum information upon receipt of such notice to ensure that no future contact is made by us. We will actively review the personal information We hold and delete it securely, or in some cases anonymize it when there is no longer a legal, business, or user need for it to be retained.

Changes to this Privacy Policy

Skooqs may make changes to this Privacy Policy from time to time. The use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use Personal Information, we will notify you by posting an announcement on Skooqs or sending you an email. Users are bound by any changes to the Privacy Policy when he or she uses Skooqs after such changes have been first posted.
